Man takes plea in fatal DUI on I-95

Investigators say Larry Garcia crashed into and killed a man on Memorial Day weekend in 2019.

A 28-year-old man pleaded guilty Wednesday to a hitting and killing someone with his car while he was driving drunk on Memorial Day weekend in 2019.

Circuit Judge Cheryl Caracuzzo sentenced Larry Garcia, who was represented by defense attorneys Andrew Parks and Adam Harmelin, to four years in prison, as agreed upon in the plea deal. Additionally, Garcia, a Port St. Lucie resident at the time of his arrest, will be on probation for six years upon his release from prison.

On May 27, investigators said Garcia, who was driving a 2014 Infiniti Q50, was headed southbound on Interstate 95 near Okeechobee Boulevard in West Palm Beach when he crashed into 26-year-old Jacari Burch’s 2017 Kia Optima, which was parked in the outside shoulder.

After the crash, Garcia and Burch’s passenger pulled him out and attempted to do CPR.

Parks, who spoke by phone Wednesday afternoon, said Garcia tried to save his life but unfortunately Burch died later that day. He said his client stayed at the scene and has cooperated with investigators throughout the case.

When Garcia’s blood alcohol level was later tested two hours after the crash, investigators recorded a .125 and .122. The legal limit for someone to drive is .08, according to law.

Parks said the sentence was short compared to other DUI manslaughter pleas, but “if anyone deserves the benefit of the doubt, he’s the guy.”
